In the news is a story about parents who feel vaccinations do more harm than good and are refusing to get their children vaccinated. They are being threatened with jail time if they don’t. Over 500 of them. In Maryland a law just went into effect requiring children to be innoculated.

In case you didn’t know, the serums have never been proven to be safe by the Center for Disease Control. They contain the heavy element mercury which has been proven to cause developmental diseases. Who knows what else is in them as the pharmaceutical companies are not required by law to tell us.

If something were known to cause health problems don’t you think you have the right to know about it? If you find out you’ve been using something that has been shown to put your health at risk and you just found out about it, what are your options? Or, you are being forced to submit to a law that you feel puts you, or your family, more at risk, what do you do?

In friday’s Wall Street Journal on page 1 was a story titled “Marketers Use Trickery To Evade No-Call Lists“. The National Do Not Call Registry was insituted to give Americans the ability to stop solicitations by phone in response to the telemarketing industry basically flooding people with phone calls. If you aren’t on the list and you are reciving telemartketing calls that you do not want I suggest you get on it.

When my girlfriend and I moved to the west coast we were hammered with 4 to 5 calls, on average, per day until we got on the list. Our phone is now peacefully quiet.

Older Americans around the country are getting duped by a seemingly innocuous tactic that can expose them to hard-sell pitches from the insurance industry.

The technique is centered on a marketing tool called the lead card, and it became popular after the federal government created its Do Not Call Registry in 2003 to shield consumers from unwanted solicitors. Sent through the mail, the lead card invites the recipient to mail off an enclosed reply for free information about, say, estate planning.

Lead cards are not illegal. Selling or leasing contact information is not illegal (although it can be a pain in the neck).

What the telemarketing industry has done is to join with the direct mail industry to do an end run around the law. By sending out lead cards the direct mail industry can then compile a database of people. These lists are then used by telemarketers to call people because a business relationship has been established.

OK, this isn’t illegal. What may be illegal is that the lead cards that have been sent are rather generic and are misleading. They do not come from any specific company per se. This technique may be fraudulent.

In the article several elderly people were pressured by the solicitors to purchase products or shift their savings into things they did not need. If you have a senior loved one pass this on to them.

What can a Prep-Paid Legal membership do in this situation?
Well since it isn’t illegal for a business to contact you about a product or service there isn’t much that can be done on this aspect of it.

If you have been contacted repeatedly and repeatedly to them to not contact you and to remove you from their call list a membership can help in this respect. If you tell them to remove your name from their lists they must do so – this is a federal law.

Most of us through our Junior, or Middle, and High School years have, or had, thought about what sex is, or was, like. Many of us have, or had, sex during those years.

Sometimes I find it interesting how things happen. I just finished reading a book about Australian Aboriginal Society. Part of the book deals with their view of sex. They view sex as a wonderful part of life and when it comes to children imitating adult behaviors about sex they don’t condone it, but neither do they punish them for it. Of course the children are pretty much capable of living on their own by the time they are 5 years old. They know how to find food and shelter and water. Their culture is structured in such a way that the children, while still children are able to act as adults when the need arises.

They, as a result of their culture do not have problems with population.

Our culture is fragmented. On the one hand our population must grow. On the other hand sex is a taboo subject. We expect our children to act as adults, but when they do it is a crime.

In the case of Genardo Wilson both parties involved were agreeable to what happened. It was not intercourse so there was chance of an untimely pregnancy.

Somehow the authorities caught word of the incident and prosecuted Mr. Wilson (Yes, Mr. as he is now an adult). He was convicted and went to jail. He refused to plea bargain because he did not feel he commited a crime nad didn’t want the stigma of being labled as a sex offender for the rest of his life.

After the incident and while the case was in court the state legislature changed the law and Genardo was tried as an adult (seemingly the law was used retroactively). While he was in jail after his conviction the law was changed again to make it a misdemeanor he was left in jail.

He is now free. My congratrulations Mr. Wilson!

I had lunch with a friend of mine who is in the insurance industry and one of the topics we discussed was Washington States proposition to allow claimants to receive triple damages for insurance companies that pay too little or take forever to pay. See my previous post.

It shouldn’t be any surprise that he will be voting against it. I on the other hand will be voting for it. Here is a brief explanation why he is against it…

A dentist in Seattle was doing some surgery on his assistant. While she was under anesthesia he implanted wild boar tusks in her mouth, took pictures and the removed them and finished the surgery. Sounds incredible? Here are the Google results for the case.

At a party he circulated the pictures and some of the other employees showed the assistant the pictures. Needless to say she was horrified and sued. She was awarded $250,000.

The dentists’ insurance company refused to defend him. He turned around and sued his insurance company for $750,000 for NOT representing him in the case. He won! The insurance company appealed and the award was overturned. He appealed to the State Supreme Court and the original verdict was upheld.

I am not one to champion insurance companies, however, I do believe that they were in the right to refuse him coverage.

My girlfriend belongs to a business networking group and just came home. She told me about some stories that the person who represents a bank in her group told the other group members.

Here is how it works:

You put something up for sale on the internet or in the paper. Someone buys it but writes a check for whatever price you ask or negotiate PLUS a significant amount more. When you notice the overage you tell them about it and they tell you to either wire the money to a certain account or send them a check for the amount of the overage.

It could very easily seem like an innocent mistake.

So you deposit the check and send them the money. The money is there (so you may think).

The check may be bogus. You could be liable for the amount of the amount of the check and/or any fees associated with bad checks that your bank may charge and/or any overdraught fees.

Unless you catch it right away (if you send a check) and put a STOP on the check you will be out the money you sent. If it was a wire transfer you WILL be out the amount of the overpayment as these are instantaneous.

These are the immediate effects.

If you send them a check – regardless of any STOP you put on it – they WILL have your bank number and your checking account number.

With a wire transfer (which requires an issuing account number and a receiving account number) they WILL have some of your banking information.

This could very easily lead to ID Theft. If it does it will eventually mess up your life.

I was out having drinks with a friend last night when she told me about an incident with her daughter, Amy, and her daughters’ friend Betty. They are both in the age range of 10 to 12 years old.

They went to see a movie one night. The movie was over at about 10:30 PM. When the movie was over they got in Betty’s mom’s car wand went to Betty’s house. About half an hour later the police showed up and wanted to question the girls as one of the theater patrons had accused the girls of stealing her handbag. The police found out who the girls were because the lady had written down Betty’s mom’s car license plate number.

Can you imagine being a pre-teen child being questioned by the police?

Of course they were extremely nervous and I am sure the police tried to be cautious in their questioning as children can easily be lead in a conversation.

A little way into the conversation Amy said she wanted to call her dad. The police said you can’t do that. At this point Amy was almost in tears. The questioning continued. Something in the back of her mind must have broken through her emotional state because she suddenly said, “I want to call my attorney!”

One of the police officers said, “Don’t be smart.”

Amy then calmly reached into her pocket and pulled out the card she had received when her mom and dad signed up for a Pre-Paid Legal Family membership. She showed this to the police officer who looked at and read the card.

The questioning wrapped up quickly and the police left.

I know that a majority of police officers are honest and forthright. I know there are kids out there that steal and commit other crimes. I know that most people, especially children, do not have access to an attorney at 11:00 in the evening. I know it is our Constitutional Right to have legal counsel while being questioned by the authorities.

I have that access. My son has that access. Do you? Do your children?

BLOGGERS TO UNITE ON BLOG ACTION DAY

All Blogs Invited to Take Part in Joining Voices to Help Environment

An international initiative of bloggers known as “Blog Action Day” launched today, with the aim of uniting thousands of blogging voices, talking about one issue for one day. This year on Blog Action Day, which is slated for Oct. 15, 2007, bloggers will be discussing the environment.

Major blogs have signed up to participate, including Lifehacker, Dumb Little Man, Lifehack.org, Get Rich Slowly, Web Worker Daily, GigaOm, The Simple Dollar, Zen Habits, Freelance Switch, LifeClever, Unclutterer, Pronet Advertising, Wise Bread and many more.

“For just one day, we’d like to unite as many of the millions of bloggers around the world and speak about one issue – the environment,” said Collis Ta’eed, an Australian blogger from FreelanceSwitch.com, and a cofounder of Blog Action Day. “We want to display the potential and the power of the blogging community, which is a disparate community but one with an amazing size, breadth and diversity. By bringing everyone together for one day, we can see just how much can be achieved, and how much we can be heard.”

Blog Action Day is a non-profit initiative, and will be an annual event. As an alternative to blogging about the environment on Blog Action Day, bloggers can opt to participate by donating their blog’s proceeds from Oct. 15 to one of several environmental organizations chosen for this purpose: Greenpeace International, The Nature Conservancy, the National Wildlife Federation (NWF), the Conservation Fund, and the Sierra Club.

Bloggers who would like to participate in Blog Action Day should visit BlogActionDay.org or email Collis Ta’eed at collis@eden.cc, so they can be listed on the Blog Action Day site. To participate, a blog just needs to write about the issue of the environment on Oct. 15, 2007, or donate its proceeds for the day to one of the chosen environmental organizations.

On Saturday, September 29, 2007 on Court TV there was a 30 minute documentary about Pre-Paid Legal Services hosted by Mike Moore, the Attorney General who brought the landmark suit against the tobacco companies and won. If you think going to court is hard try being in his shoes. He had two assistant AG’s with him against 68 tobacco attorneys AND the governor of Mississippi!

Last night I was out to dinner with a friend and talk came around to our businesses. One of the reasons why I wanted to get together with them was that the industry they are in is really starting to go green and I wanted to see and talk about this with them.

They are in the ad specialties business – you know, the give away pen people, the logo’d note pad people, the people who flood the world with stuff to get businesses noticed. The industry is getting away from plastic (yay!) and going with biodegradeable or natural items.

What came up during our conversation was Identity Theft. They were familiar with our legal plan but did not know about our ID Theft protection and resoration offering.

Anyway, they had been out to dinner and gave their credit card to the waitress (like most of us do), paid the bill and left. When they received their credit card statement there was a charge for some exercise equipment delivered to another address.

After much hassle and I don’t know how long, only part of it was resolved – the credit card company removed the charge from their bill. They called the police where the equipment was delivered to report the crime and they said that it was another jurisdiction’s concern as that was where the credit card number was stolen. They then called the other jurisdiction who said it was up to the first jurisdiction as that was where the goods were delivered.

How many of us have encountered this, or a similar, situation? I know I have (but I will save that for another post. What does one do? What can one do? At the very least consult an attorney.

In the state of Washington there is a measure coming before the people that would allow people to collect triple damages from any lawsuit won against insurance companies. Needless to say the insurance companies are up in arms about this. In fact, they have put $8,000,000 into a campaign to stop this. They claim it will cause your insurance premiums to rise (the question is what doesn’t make your premiums to rise?).

Proponents have only raised a little over $800,000. Seems like a David and Goliath Story.

Interestingly, the state Attorney General is against the measure while the state Insurance Commissioner is for it.

I have not heard anything about what the AG has to say about it, but the Insurance Commissioner said that if the companies play fair and do what is in the policies they write they won’t have much of a problem. When asked why the insurance companies would be against this he replied that they basically have it too good with the way things are.

On talk radio I listened to a man who was an insurance industry insider. His take on the whole industry could be summed up as this “pay as little as possible and take as long as possible to pay it.” What would this do for insurance companies? Maximize profits. It is as simple as that.

When you get an insurance policy you should have it reviewed by an attorney – it is a contract written by the insurance company’s lawyers! Anytime the policy is changed you should get it reviewed by an attorney. Anytime you have a question about something in the policy talk to the insurance company and then talk to an attorney. Anytime they refuse to pay or take too long to pay talk to an attorney.

What is the common thread in the sentences in the previous paragraph? If you are not sure it is always consult with an attorney ANYTIME you are being seperated from your money, not getting money due you or anytime someone fails to fulfill their side of an agreement. I guarantee the big companies do.
